Who these terms are for
These Terms of Use apply when you visit ShelfTonight, browse a shop, search, or buy something — as a guest or with an optional buyer account. If you open a shop, you also agree to the Shop terms at /terms/shops.
ShelfTonight is platform software: a website that helps shops turn leftover photos into a storefront and lets people pay for one item at a time. The Cape May Store is the company that builds this software — the machine. It is not a shop on ShelfTonight, not a boutique, and not the seller of anyone’s goods. These pages describe how that software works. They are not legal advice. ShelfTonight is not a law firm. Have a lawyer review this language before you rely on it in production.
What ShelfTonight is
ShelfTonight (the company and the site at shelftonight.com) provides software. It is a marketplace of independent shops. Each shop is its own storefront at https://shelftonight.com/s/{shop_code}. That path is the only public shop URL on this site. There is no cart that mixes every shop into one checkout. We are not the store.
The shop that listed the item is the seller of that item. ShelfTonight is not the seller of the goods, not the shipper, and not the store you pick up from.
Using the site
You may browse public pages, shop pages, categories, and search without an account. Search queries can be written to server logs (hits.jsonl) even when you are logged out.
Checkout is guest-first: you provide a name, email, and phone, plus a ship-to address if the item ships or a pickup name if you will collect it. Paying does not require a buyer account. After pay you may optionally create an account to track that order. Guests can also look up an order with the email used at pay and the order id.
Do not scrape, attack, or overload the site. Do not try to buy with invented prices, fake postage, or someone else’s payment method. We can refuse, hold, or reverse a checkout when something looks wrong.
Accounts
A buyer account is optional. It stores a sign-in cookie, a saved ship-to if you add one, and orders we can attach to you so you can open a receipt and packing or shipping status. Shop owner accounts are separate and are required to run a shop.
You are responsible for the email and password you use. Tell us at support@shelftonight.com if you think someone else is in your account.
Payments
Card, Apple Pay, and PayPal run through Stripe. We do not keep your full card number. The charge is item + tax (if the shop charges tax) + shipping (if it ships) + a 5% platform fee (minimum $1) + a card processing fee. The shop receives the item, tax, and shipping. ShelfTonight keeps only the 5% platform fee. Read /fees and /refunds.
Items, photos, and conduct
Shops upload photos of what they have. We do not invent a price, brand, postage, or address. If a listing looks like a weapon, an unsafe kids’ item, a fake, or a photo with someone’s face or personal details, we can flag it, hold it, or take it down. See /prohibited.
Do not harass shops or other people. Do not post others’ personal information.
Holds, removal, and availability
We can hold or remove a listing, a shop, or an account when we believe these terms, the shop terms, or the law may be at risk — including weapons, unsafe kids’ items, suspected fakes, and personal information in photos. We can also pause checkout if Stripe is not connected or a price is missing.
The site is provided as-is. Tonight’s dump can go backstage. We do not promise uninterrupted uptime.
Limits
To the extent the law allows, ShelfTonight is not liable for the quality, authenticity, safety, or delivery of a shop’s goods, or for a shop’s pickup hours. Your purchase is with the shop. Our responsibility for the software is limited to the platform fee you paid on the order at issue, except where the law says we cannot limit liability (for example, for fraud or personal injury we actually caused).
Changes
We may update these terms. The date at the top of this page is the current version. Continued use of shelftonight.com after a change means you accept the new terms for later visits and orders.
